A Free Democrat speaks freely

As a FREE democrat who is not enslaved to, or owned by the party leadership, I am able to speak the truth without having to check it against the approved platform, or officially approved lies of the leadership.

The Affordable Care Act (ACA) is the law of the land.  However unless you like wealth redistribution schemes, it is a bad law. 

It’s primary structure is to enslave more citizens to dependence on the government’s willingness to redistribute wealth, and or add additional public debt, on those that “can afford it” in order to “give a handout” to those whom they seek to buy.

It was passed by a narrow margin in the House, in a “take it or leave it” package from the Senate, because the votes no longer existed to modify what was passed in the Senate before my party leaders lost the 60 votes they needed to push the legislation forward.   It was flawed, but Nancy wanted something badly enough to say “let’s pass this so we can find out what is in it”.

The president used his bully pulpit to lie to the wavering votes, and citizens, by telling them they could keep their Doctor, and their insurance plan, when he knew there were no such guarantees.  If fact it was highly unlikely that stability was being increased by the ACA, which would have been necessary to end the existing practice of Doctors and hospital being removed from insurance plans.

The ACA is affordable to those whom the government will subsidize with debt.  It is affordable to those with chronic conditions who will have their cost pushed onto others.  It is affordable to the non medicare older population who will have their cost pushed onto the youth. 

The three time multiplier that is in the ACA, guaranteed that the young and healthy would pay more, so the sick and old could be subsidized. 

Using a auto insurance analogy may make this easier for others to understand how nonsensical the ACA requirements are for the young and healthy (aka good drivers).  

If you are in a wreck every day (chronic), and do not learn how to drive better, you will still get insurance, and will not have to pay more than three times what the person who has never had a wreck must pay.   Additionally neither the good or bad driver may purchase a liability only policy.  Rather you must now buy the million dollar limit policy.  The good driver is punished to subsidize the bad driver, and further punished by being required to buy more than he needs, in order to subsidize the bad driver.    The bad driver has no incentive to get better, as he will always have coverage, and will never have to pay more.

It just makes no sense.

Millions will loose insurance from their employers.  Millions will need the government to add to the national debt to make up for the high price of “full featured” health insurance, and everyone will still die.   The only thing that will change is how much is spent on them before they die.  If the government does not ration care, the rates will climb.   If the government rations care, many will complain.

And there you have it, a flawed law, with bad outcomes, that only Free Democrats can admit beforehand.  Others will admit it only when trying to “fix” the website, the cancellations, the under supply of doctors, the backlash from employers cutting to 30 hour work weeks in order to avoid the increased cost of the ACA compliant plans.  We already see these things.  More will come.   Some in the know, could tell us what is next, but that would be against the party line. 

That’s the way I see it tonight.

And now we know – you can tax folks for not following instructions.

Congress called it a penalty, but the Supreme Court says they over reached on Commerce Clause, but were completely constitutional to tax non conformity.  Even though they did not call it a tax, and went out of their way to say they were not creating a middle class tax on the young and healthy, the Court said, its okay, because it really is a tax, and Congress can tax non conforming behavior.  Wow!

I only wonder what non conformity Congress will choose to tax next.  If the socialist gain control of Congress I expect them to tax any behavior they do not like.   I can imagine a tax on failure to attend a public school, and choosing any alternative like  home schooling or private school educations.

Barack smack down on the Supreme Court, round two.

“I’m confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress,” Obama said. “I’d just remind conservative commentators that for years what we’ve heard is the biggest problem on the bench is judicial activism or a lack of judicial restraint.”

“That an unelected group of people would somehow overturn a duly constituted and passed law. Well, here’s a good example. And I’m pretty confident that this court will recognize that, and not take that step,” Obama said.

I hope these words work to create a 9-0 vote to strike down Obamacare.  If I were a justice this would make me think twice about the power that the Democratic Party exercised, and abused.  When Barack thinks that a bare minimum, one vote margin, is “a strong majority of a democratically elected Congress” it is clear that his opinion of its constitutionality is fogged by the same self assessment.

The courts were given power to protect the citizens from a government that trampled on their rights.  Even a 100% vote in the Congress could be an abuse of the rights of The People.  Majority votes, near party-line votes, do not mean the bill was constitutional.   Given the strange brew that was cooked up to get the votes to pass Obamacare, it is harder to think this is constitutional, than it will be to see that it is a flawed bill, that violates the rights of free citizens to remain free from government abuse.  

I am not the only Democrat to want to yell  “Don’t tread on me”.  I hope some of the Democrats on the Supreme Court find the courage to tell Congress and Barack that they violated the citizens rights to be, and remain free, from Federal abuse.

That’s what I’m thinking tonight.

Does the truth in advertising law apply to Washington?

I guess not, as this news cycle shows.

The IOM’s report, “Clinical Preventive Services for Women: Closing the Gaps,” also said US health plans should provide free screening for gestational diabetes and free counseling on sexually transmitted infections and HIV.

Other recommendations included free lactation counseling and breast pump rentals to promote breast-feeding — services that most mothers of newborns pay for out of pocket — and regular screening and counseling to detect domestic violence.

Birth control pills are often covered, at least partially, by many health insurance plans but the committee recommended they be issued without any co-payment by the patient.

The potential costs of adding blanket coverage of the eight services were not considered as part of the group’s review.

The reason Obamacare will further bury the US government, and our grandchildren in debt, is making more stuff “free”.  We can not afford “free”. 

Of course what they really mean is that employers, the self insured and the government will pay more, so that their special interests pay less.   

This happens over, and over, and over again, in the “compromises” that get legislation passed.   Better to say “no” to toxic legislation, than “yes”, unless of course your re-election is based on paying for those contributions.

Progressive Socialists vs Constitution

What a sad state of affairs.  When Nancy, Harry and Barack tell the states, effectively  ‘We crammed it through and signed it, get over it.  The constitution and the courts be damned. ‘

“Healthcare reform is the law of the land and, now that Americans see its benefits, a majority of them oppose Republicans’ dangerous plans to repeal a law that put patients in control of their own healthcare,” said Senate Democratic leader Harry Reid

States involved in the lawsuit were Alabama, Alaska, Arizona, Colorado, Florida, Georgia, Idaho, Indiana, Louisiana, Michigan, Mississippi, Nebraska, Nevada, Pennsylvania, South Carolina, North Dakota, South Dakota, Texas, Utah, Washington, Iowa, Ohio, Kansas, Maine, Wisconsin and Wyoming

U.S. District Judge Roger Vinson  ruled that the reform law’s so-called individual mandate went too far in requiring that Americans start buying health insurance in 2014 or pay a penalty. “Because the individual mandate is unconstitutional and not severable, the entire act must be declared void,”

“Regardless of how laudable its attempts may have been to accomplish these goals in passing the act, Congress must operate within the bounds established by the Constitution,”

When the Progressive Socialists don’t like a law passed by the majority, they go to the courts to have it overthrown.  When their efforts to trample the freedoms of Americans to achieve their progressive socialistic agenda runs afoul of the constitution, they find fault with the judge.

Conservative Democrats do NOT WANT ObamaCare.   Conservative DEMOCRATS want Americans to be free to choose for themselves on a level playing field.  Conservative Democrats are willing to allow behavior to have consequences.  In fact they would demand that consequence for personal behavior not be transferred to the innocent. 

ObamaCare asks health conscious Americans to subsidize the cost of care for those who poison their own bodies and ask others to pick up the tab.

Nancy, Harry and Barack and the Progressive Socialistic agenda are wrong.

One year later …

One year ago, the Senate, controlled by my party, defied the will of The People, and approved ObamaCare.   If Harry had not abused his fellow Senators, and held them captive in D.C. (rather than allowing them to go home for Christmas) until the Senate version of  ObamaCare was approved, I might have never become a candidate for Congress.

Without that vote on Christmas eve day, and with the loss of the super-majority, perhaps ObamaCare would not have ever passed in 2010, as reconciliation would not have been available to the Progressive Socialistic members of the Party as a means to cram legislation down the throat of the majority of American who do not want to become like Europeans. 

Our First amendment was to keep the government from taking on the role of religion.  Unpaid for, social care, is the business of religion not government.  That is not true in Europe, where constitutions do not prevent the government from establishing religion, but it should be true here in America.

While I will go along with those who say the government should be able to offer and sponsor retirement plans that are fully paid for by participants; plans that offer benefits that are greater than any actuarially determined values of the contributions made, are either Ponzi schemes, or the act of religious charity and should not be the acts of the American government.  I know the progressive socialists in the Party would disagree, but they do not agree with much that the Founding Fathers of America would have held forth as the limits, and requirements,  of men and government.

One year later, I am not in Congress, but the Party has lost control of the House, because we failed to keep control of the zeal of the progressive socialists.  The Heartland of America, and the Heart of the Democratic party still wants the American Dream, not Europe revisited. Keeping Nancy as party leader in D.C. tells America, those who were re-elected have not listened.  Maybe in 2012 many conservative Democrats will stand up to run and win, and push the progressive socialists out of party power.

One year later, I have a blog, and remain a commentator on the news of the day. 

One year later, Barack is out from under Nancy’s control, and striking deals with the GOP. 

One year later, I see the frustration with Tea Party members, who having helped reject our party, but now are seeing the other party does not keep to the pledges the Tea Party wanted.

One year later, we still have a government that does hold itself accountable to ONE ISSUE legislation, that either stands on its merits or fails.  One year later we still have politicians cutting deals, and putting together poisonous legislative sausage.  You get yours, I get mine, we get reelected, and our grandchildren will have to carry the pain.

When will it stop?  Maybe two years from now?  Let’s not give up, but lets work to get back to personal responsibility and accountability.

How much worse does it need to be?

The American voter has shown that the Socialistic leaning, cram it down your throat, like it or not, leadership style of Nancy, Harry and Barack have been rejected.  This is not the type of Change they voted for in 2008. 

In some states political maneuvering to control, choose or destroy the opposition, allowed for Democratic wins (Harry nice choice of opposition).

In districts secured by gerrymandering, Democrats could win.  But in far to many races, where districts are competitive, and where FREE citizens had a true choice, they rejected our party and chose to let the Republicans take over to prevent Nancy, Harry and Barack from cramming more bad policy down their throats. They put a stop to that type of Change. 

After the pounding, I thought Nancy and Harry would get the message, and step down from leadership.  But I now know that for Nancy, the interest of American’s and the Party are secondary to her hunger for power.  I am dismayed that she would seek to hold onto party power, rather than allow the Congressional Democrats to choose a leader who would demonstrate to Free Americans, that we get it and will reject the Socialistic leaning direction of the “Progressive” leadership and turn to Conservative Democrats to lead the way.

Perhaps Nancy is miss counting the votes, and will be turned down by the caucus.  But assuming she is right, I can only imagine that she will lead the new party of “NO”. 

Barack ran for change, perhaps without Nancy to push him around, he can show us the type of change that might lead to improvements for Free Americans.

It is time for the Party to set the captives FREE.  To many of the “Progressive / Socialistic” leaders treat minorities like their property (slaves).  Held dependant on the party to provide for them, rather than the traditional Democratic values, of creating a level playing field where hard work could lead to experiencing the American dream.

We have become the party that buys votes by delivering the bacon, and giving the bill to our grand children to pay.  I think we likely lost because there are still enough FREE Americans who vote for America and delayed gratification, instead of for their short-term satisfaction.  We need to return to our old values. 

We should hear their message and help repeal the bad portions of Obama Care.  It was poorly delivered.  With a take it or leave it Senate version, Nancy pushed through, and down the throats of all Americans, legislation that many FREE Americans rejected. We need to help pass amendments to drive down cost, rather than drive up the government role in providing the premiums with government provided healthcare. 

Cadillac plans should be on our target list to eliminate or tax. Even if our union members will feel the change,  how can we support hiding income, and letting some have unequal care with taxpayer support? It is not morally right.

Having defeated me in the primary, Pete was reelected to my district as expected.  With the loss of control of the house, he will no longer be chair of the sub-committee on health.  He therefore will not be able to worsen the healthcare of Americans. The majority will work to reverse the bad legislation.  Barack will likely veto the effort, and I predict that if he does, the Republicans will have a message for 2012 that will lead to more losses.

Nancy, please step down from leadership.   Harry, please step down from leadership.   Barack, please show you can lead the type of change you offered, or we may give the Republicans in 2012, what we had in 2008, the power to push through legislation that should never have been approved.

Tonight we set the clocks back an hour from Daylight Savings Time, to Standard Time.  Maybe it is also time to set the clock back from Progressive / Socialistic /Nanny Government time, to Hard Work / Individual effort /  American Dream time for the Democratic Party.

The PEOPLE deserve a Congress of statesmen, not Partymen.
